1.2 Definitions

"Service": The MyCover Hero platform for generating YouTube thumbnails using artificial intelligence
"User": Any person using the Service
"Account": User's personal space on the platform
"Content": Any data, image, text, or element transmitted via the Service
"Credits": Virtual units allowing the use of Service features

1.3 Scope of Application

These Terms and Conditions (hereinafter "T&C") govern the use of the MyCover Hero Service. Use of the Service implies full acceptance of these T&C.

1.4 Modifications

REMOTE MONKEY reserves the right to modify these T&C at any time. Modifications become effective upon publication. Users will be informed of significant changes.

2. SERVICE DESCRIPTION

2.1 Main Features

MyCover Hero is an automated YouTube thumbnail generation service using artificial intelligence, offering notably:

Image generation from text descriptions
Creation of personalized AI avatars
Advanced thumbnail customization
A/B testing of different versions
Creation library

2.2 Service Evolution

REMOTE MONKEY may evolve the Service, add or remove features according to its technical and commercial needs, with reasonable notice for substantial modifications.

2.3 Future Integrations

The Service may integrate third-party platforms, notably YouTube, subject to agreements with these platforms.

3. REGISTRATION AND USER ACCOUNT

3.1 Registration Conditions

Registration to the Service is open to any natural or legal person. No specific age restriction is imposed, but we recommend parental supervision for minors.

3.2 Registration Information

The User undertakes to provide accurate, complete, and up-to-date information during registration and to maintain them as such throughout the duration of use.

3.3 Account Responsibility

The User is solely responsible for the confidentiality of their login credentials and all activities performed on their account.

3.4 Suspension or Deletion

REMOTE MONKEY may suspend or delete an account in case of non-compliance with these T&C, without notice or compensation.

4. SERVICE USE

4.1 Compliant Use

The User undertakes to use the Service in accordance with its purpose and these T&C. They particularly refrain from:

Generating pornographic, violent, racist, or defamatory content
Using the Service for illegal activities or harming others
Attempting to circumvent technical limitations of the Service
Sharing their login credentials

4.2 Prohibited Content

Strictly prohibited content includes:

Pornographic or sexually explicit content
Violent content or inciting violence
Racist, discriminatory, or hateful content
Defamatory content or infringing on privacy
Content violating intellectual property rights
Disinformation content

4.3 Commercial Use

Commercial use of the Service and generated content is authorized within the framework of subscribed plans.

4.4 Monitoring and Moderation

REMOTE MONKEY reserves the right to monitor and moderate generated content, without obligation. Any non-compliant content may be removed without notice.

5. ARTIFICIAL INTELLIGENCE AND INTELLECTUAL PROPERTY

5.1 Personalized Avatars

The User provides their photographs for training their personal AI avatar
This data is used exclusively to create the User's avatar
Created avatar models remain strictly private and confidential
REMOTE MONKEY cannot use these models for other purposes

5.2 Generated Content

The User holds rights to content they generate via the Service
The User guarantees having necessary rights to elements they use
The User is solely responsible for content they generate and its use

5.3 User Responsibility

The User undertakes to:

Respect third-party intellectual property rights
Not use images of people without their consent
Assume responsibility for the use of generated content

5.4 AI Technology

The artificial intelligence technologies used by REMOTE MONKEY are proprietary and protected. The User cannot attempt to reproduce or exploit them.

6. FINANCIAL CONDITIONS

6.1 Pricing Models

The Service offers several models:

Free credits: Offered upon registration with limitations
Monthly/annual subscriptions: Renewable credits with premium features
Credit purchase: One-time purchase with one-year validity

6.2 Pricing

Rates are available on the website and may be modified at any time. New rates apply to new purchases only.

6.3 Credit System

Subscription credits do not accumulate and are renewed each period
Purchased credits have a one-year validity
Cost per use is regressive according to subscription type

6.4 Payment

Payments are securely processed by Stripe. Stripe's payment conditions apply.

6.5 Billing

Subscriptions: Automatic recurring billing
Credits: Immediate billing upon purchase
VAT applicable according to current legislation

7. REFUND POLICY

7.1 General Principle

No refund is granted by right given the nature of the Service (consumed intellectual services).

7.2 Exceptional Refund

A refund may be granted at REMOTE MONKEY's discretion in case of:

Major Service malfunction
Demonstrated erroneous billing
Exceptional justified circumstances

7.3 Procedure

Any refund request must be addressed via https://mycoverhero.com/contact-us with appropriate supporting documents.

8. TERMINATION

8.1 Termination by User

The User may terminate their account at any time via their account settings: Settings → Delete Account → Password confirmation

8.2 Termination by REMOTE MONKEY

REMOTE MONKEY may terminate Service access in case of:

Non-compliance with these T&C
Non-payment of amounts due
Fraudulent or abusive use
Prolonged account inactivity

8.3 Effects of Termination

Termination results in:

Removal of Service access
Data retention according to privacy policy
Loss of unused credits (without refund)

9. REFERRAL SYSTEM

9.1 Operation

A referral system is managed by the third-party service First Promoter according to its own conditions.

9.2 Conditions

Specific conditions of the referral program are available in the user interface.

10. LIABILITY AND WARRANTIES

10.1 Limitation of Liability

REMOTE MONKEY provides the Service "as is" without express or implied warranty. REMOTE MONKEY's liability is limited to the amount of sums paid by the User during the last 12 months.

10.2 Warranty Exclusion

REMOTE MONKEY excludes any warranty concerning:

Continuous availability of the Service
Absence of errors or bugs
Adequacy of the Service to User's specific needs

10.3 User Responsibility

The User is solely responsible for:

Their use of the Service
Content they generate and distribute
Consequences of using generated content

10.4 Force Majeure

REMOTE MONKEY cannot be held responsible for non-performance of its obligations due to force majeure.

11. INTELLECTUAL PROPERTY

11.1 Service Ownership

The Service, its source code, design, and all elements composing it are the exclusive property of REMOTE MONKEY.

11.2 License of Use

REMOTE MONKEY grants the User a personal, non-exclusive, and non-transferable license to use the Service.

11.3 User Content

The User retains intellectual property rights to content they generate via the Service.

11.4 Respect for Third-Party Rights

The User undertakes to respect third-party intellectual property rights and guarantees REMOTE MONKEY against any recourse in this regard.

12. PERSONAL DATA

Personal data processing is governed by our Privacy Policy, an integral part of these T&C.

14. DISPUTE RESOLUTION

In case of dispute, parties will endeavor to find an amicable solution before any judicial recourse.

14.2 Competent Jurisdiction

Failing amicable resolution, any dispute will be under the exclusive jurisdiction of French courts, notwithstanding plurality of defendants or third-party claims.
